Mrs. Emem Hoffmann and Mr. Jan Hoffmann
Human rights organization in Nigeria, Civil Liberties Organization, CLO, has petitioned the German Government through the German Ambassador to Nigeria over the travail of a Nigerian woman, Mrs. Emem Hoffmann, married to a German, Mr. Jan Hoffmann, in a controversy over the custody of their child, Uriah Hoffmann, coercively kept at a Foster Care in Germany on the order of the husband.
The CLO issued a petition, via a statement signed by Princewill Akpakpan, Head of Legal/Litigation Unit on Tuesday.
The group in the statement protested that “these institutional sex violence, child sex crimes, child torture and child psychological distress have been brought before the Federal Republic of Germany through its institution – BUNDES JUSTIZAMT – yet, no action has been taken to save the child from this degenerating and unpalatable situation.”
The CLO asserted that Mrs. Emem Hoffmann, is contesting for: Unlawful, insensitive and improper taking into Foster Care of her child, Uriah Hoffmann, with falsified documents sent to Bremen Court by Jugendamt-Matthias Meyer, and Harmut Engelland, supposedly government child protection officers; The hiding and suppression of the Pediatrician’s Medical Evaluation Report of a sexually abused child by the same Bremen Court, and the Jugendamt Bremen, to obstruct justice and rule of law to insensitively and wrongly justify the taking into Foster Care of Uriah Hoffmann in September 2022.
“The series and chains of falsified documents that follow from the court parties, abuse of positions, manipulations and misuse of legal tools and the deliberate placement of Uriah Hoffmann in a Foster Care of disabled children where he is mauled by pedophiles’ network wherein there is evidence of anal rape of her son, abuse and assault for over two years… in the care of government institution – the Jugendamt Berlin – Lichtenberg.
The CLO, therefore, called on the Chancellor and Authorities of the Federal Republic of Germany, as State Party of international law/convention, to take prompt and decisive steps to cause its Executive and adjudicatory institutions to address these issues within the shortest time frame to ameliorate the current disgusting situation wherein Emem and her child, Uriah, have been subjected to under the state apparatus deserving of excoriation.
CLO demanded immediate release of Uriah from the unlawful and bias Foster Care capture.
According to the CLO, Mrs. Emem Hoffmann is simply demanding justice and liberty – “proof of life of the child, with witnesses also viewing”; and “the release of the child according to the German and international law”. The law prescribes that ‘a child having gone through such a horrific incident be immediately released’.
After about two years of marriage in 2017 in Germany, Mrs. Emem Hoffmann discovered strange and unethical behaviours of anal sexual abuse and pornography from the German husband, Mr. Jan Hoffmann, with their son, Uriah.
This degenerated into heated disagreement that culminated into marriage separation and divorce suit against Mr. Hoffman.
Subsequently, Uriah Hoffmann was taken from the mother’s custody and dumped in Foster Care facility inhabited by disabled children at the age of three years.
Mr. Jan Hoffmann was an officer of the German Navy. He has been manipulating the judicial process to frustrate the Nigerian wife, communicating false information to the German authorities that his wife, Emem Hoffmann, has a mental ailment.
Uriah has spent about four years at the Foster Care without parental care, without primary education and is currently seven years.
Mr. Jan Hoffmann, according to the wife, has strong alcoholic, habitual smoking and excessive pornographic addictions. He unleashed intolerable domestic violence on his wife, Emem Hoffmann, and their son, Uriah Hoffmann, when intoxicated.
Mr. Hoffmann used false mental illness to blackmail the wife in contesting the son’s custody.
The CLO, in a petition to the Federal Republic of Germany, through the German Ambassador to Nigeria, signed by Princewill Akpakpan, Head of Legal/Litigation unit, copied the Un Special Rapporteurs on Sale, Sexual exploitation and sexual abuse of children.
The UN Special Rapporteurs on Violence Against Women and Girls, acknowledging the petition, noted: “Working Group Discrimination Against Women and Girls Based on Resolution 52/26,50/17 and 50/18.”
UN Special Rapporteurs expressed Concerns
Allegations of sexual abuse against the 6-year-old child – at the time of the petition, lack of access to care and rehabilitation services, lack of access to Justice, neglect of general wellbeing of the child in alternative care placement.
The UN Special Rapporteurs, accordingly, declared “A strong allegation of violation of the child right to safety and protection from sexual abuse and right to maternity and access to justice – relevant authorities not doing enough to protect the child and stop abuse.
“Strong indication that children are not allowed to share his experience or seek justice in respect of the harm they have suffered. They should be involved in both investigative and justice processes given their pains and trauma. No attempts were made to find out from the child what happened.
“Despite the child’s persistent plea to stay with the mother, the institution objected and did not place the interest of the child as paramount, leading to further abuse without ascertaining the best interest of the child.
“Discrimination against the mother because she raised accusation against the father and nothing was done to investigate the accusation.”
The German authorities are yet to take action on the responses of the UN Special Rapporteurs.
Mrs. Emem Hoffmann vehemently agitate Mr. Hoffmann’s disorder behavior, sexual child abuse, including anal sex; pornography and alcoholic inducement, which hindered the development of the child.
The Bremen Police once intervened in Mr. Hoffmann’s domestic violence. The Police took the wife and the child to Women Shelter for safety and accommodation as a result of incessant violence on the wife and the child.
Mr. Hoffmann insisted that the child must go to Foster Care.
The child suffered trauma from the father’s sexual assault, making the mother seek Pediatric help.
On appointment of the child with the Pediatrician, Mr. Hoffmann misinformed the Doctor that his son had autism and deafness.
The false information led to the transfer of the child to the Bremen Ministry of Health for analysis and examination. The result showed that the child neither had autism nor suffer deafness.
The Ministry of Health sent the report to pediatrician, Claudia Karstein, but the report is missing in the Family Court File.
Mrs. Emem Hoffmann had secured a job in nearby country, Poland, in an Oil and Gas company, and took the child with her. But Mr. Hoffman quickly filed a suit, requesting full custody of the child. The woman lost her job because of the suit, and the son lost his kindergarten placement slot.
At the time Uriah had contacts with the father, on returning, the child displayed offensive pornography, smoking and sex behaviours. This was reported by the mother to the Bremen Family Court, the Pediatrician, and the Police.
The Pediatrician requested contact between Mr. Hoffmann and the child be suspended immediately, and the mother and the child be given Family help. Her report is missing in the Court file.
The Bremen Court at a court hearing in August 2022, dismissed the allegations; the Judge exonerated Mr. Hoffmann, but sent Krisendienst – Mental illness crisis management to Emem Hoffmann and the child.
The Police Bremen dismissed the case, saying the child is too young to testify in court.
Emem informed the Bremen Court in the August 2022 hearing of her new job in Berlin, and her desire to move away from Mr. Hoffmann’s apartment, which was source of death threat from Mr. Hoffmann.
This was reported to the Police Bremen. On relocation, the Police dismissed the case, saying she has changed location, and there was no longer any threat.
The child continued to share Foster Care facility with impaired children while he is healthy, causing him trauma.
